TERMS OF SERVICE

 

OVD swim is a business founded and owned by Jeannique Felix and Lakisha de Lanooi, under KVK number 66068088 and VAT number: NL239078652B01. De registered office is at Kees van Dongenhof 22. 3024NA, Rotterdam.

The following terms and conditions listed below will apply for every order you place on the website www.ovdswim.com. The terms do not affect your statutory rights.

 

ART 1: Delivery of goods

 

You will get a confirmation email with details of the goods that you ordered. These goods will be delivered to you all at once. If for any reason your order can not be processed immediate action will be taken and you will be made aware of the complications as soon as possible so measure can be taken.

 

ART 2: Prices

 

We try our best to make sure that all prices on the website are accurate, however errors may occur. We will inform you as soon as we discover this, and we will contact you, so you can reconfirm your order with the correct price. You will also get the option to cancel your order if you no longer wish to purchase the item after the price has been corrected. If you cancel your order, we will contact you to set a refund process in place.

 

ART 3: Shipping (domestically and international)

 

We are based in the Netherlands. If your delivery address is not within the Netherlands, you may have to pay import taxes (these may vary from country to country). We are not responsible for extra fees at customs or for any other extra payments after the package has been delivered to the concerned country. For extra information regarding customs we advise our customers to contact the local customs office.

 

Note that packages may get opened by customs authorities if they cross borders.

 

ART 4: Data

 

Information provided to us by our customers will strictly be used for purposes regarding the order. We will not use this information with marketing purposes unless we get consent from the client.

ART 5: Payment

 

All orders will be handmade after the payment is completed. If payment fails or for some other reason is not completed your order will not be processed and the item will not be made. OVD will not be liable for delay or non-delivery of the products.

 

ART 6: Returns

Due to the fact that our items are handmade specifically for each customer, refunds are not issued. If you choose to return an item you will receive store credit.

All returns must be pre-approved by the ovdswim team and received within fourteen (14) business days. The customer is responsible for shipping costs when returning the item, as well as when receiving a new item. 

All sales from products that have a discount are final. products bought during a sale are not eligible for return/ echange/ store credit. If you need help finding the right suit or size please contact us before making the purchase.

Products must be returned in original condition: unworn, undamaged, no stains or marks etc.

If you receive a damaged item we can issue an exchange or repair. Please notify customer service immediately of any damages (within  7 days after receiving the order). 

 

ART 7: Incorrect deliveries

 

In order for us to straighten out the error, we should be notified about incorrect deliveries within seven days after delivery. Failure to do so automatically means that you have accepted the delivered products. When contacting us please state the invoice number as well as full name, address and the concerning product. If we are not provided with all required information/ if the information is not correct, we cannot take your request into consideration. We will check the invoice and the (incorrect delivered) product to decide which measurements to take. When the product was in fact delivered incorrectly we may require you to return the concerning product to us (at our cost). We can then either replace the product free of charge or refund the full price of the item in question to you.

If you do not notify us accordingly, we shall have no liability for any errors and there will be no replacement of the item or refund.

 

 

ART 8: Force majeure

 

OVD has no liability for any failure to deliver goods or any delays or any damage or defect to the delivered products, when these are caused by any event of circumstance beyond its reasonable control.

 

ART 9: Validity terms and conditions

 

If for any reason part of our terms and conditions are not valid, the remaining terms and conditions will not be affected.

 

ART 10: Promotion codes

 

Only one coupon can be used per order. They will be valid for a limited time only (when they are no longer valid they cannot be used).

If an item is delivered incorrectly after applying a coupon code, we are only required to refund the amount that was paid by the customer.

OVD can terminate the availability of a coupon code at any desired time.

 

ART 11: Care guidelines

 

Our products will have a longer lifecycle if they are hand washed. The choice to wash them otherwise is completely yours. But we will not be responsible for a shorter duration of the item.

 

ART 12: Validity

 

By ordering our products you are accepting these terms and conditions. Note that they can change at any time. It is your responsibility to check before every order if there were any changes that may affect you.

 

ART 13: Klarna payments

 

In cooperation with Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden, we offer you the following payment methods. Payment is to be made to Klarna.

  • Pay in [14] days: The payment period is 14 days from shipment of the goods or tickets/ availability date of the service. You can find the complete terms and conditions for the markets where this payment method is available here: United Kingdom, Germany, Sweden, Norway, Denmark, Finland, Austria and the Netherlands.
  • Direct banking: Available in Germany, Austria and the Netherlands. Your account will be debited directly after placement of your order.
  • Direct Debit: Available in Germany, Sweden, Austria and the Netherlands. Your account will be debited after shipment of the goods or tickets/ availability date of the service ​or in case of a subscription in accordance with the timelines communicate​d. You will be notified about the date(s) by email.

The payment methods Pay in [14] days, Slice It and direct debit are only available in case of a positive credit assessment. For this purpose, during the order process and handling of your purchase, we forward your data for an address and credit check to Klarna. We can only offer you the payment methods available based on the result of the credit check. General information about Klarna and the user terms per country can be found on klarna.com. Your personal data is handled in accordance with applicable data protection law and in accordance with the information in Klarnas privacy statement.

 

In order to be able to offer you Klarna’s payment options, we will pass to Klarna certain of your personal information, such as contact and order details, in order for Klarna to assess whether you qualify for their payment options and to tailor the payment options for you.
